Court Case to Compel Implementation of Section 210 of Constitution

Section 210 of the Constitution states:
“An Act of Parliament must provide an effective and independent mechanism for receiving and investigating complaints from members of the public about misconduct on the part of members of the security services, and for remedying any harm caused by such misconduct.”
HLATSHWAYO JCC: One of the crucial elements of the new constitutional dispension ushered in by the 2013 Constitution is to make a decisive break from turning a blind eye to constitutional obligations. To achieve this goal, the drafters of the Zimbabwean Constitution Amendment (No.20) Act, 2013 (“the Constitution”) adopted the rule of law and supremacy of the Constitution as some of the core founding values and principles of our constitutional democracy.
IT is hereby notified that the Chief Justice has, in terms of paragraph 18(4)(b) (Part 4) of the Sixth Schedule to the Constitution of Zimbabwe as read with section 27 of the Supreme Court Act [Chapter 7:13], directed that the sitting and vacation of the Constitutional Court during the year 2021 shall be as specified in the Schedule.
IT is hereby notified that the Minister of Justice, Legal and Parliamentary Affairs has, in terms of subparagraph (iv)(a) of paragraph 18 of the Sixth Schedule to the Constitution approved the following rules:—
1. These rules may be cited as the Constitutional Court (Amendment) Rules, 2020 (No. 2).
The Judicial Service Commission [JSC] has published a Position Advertisement announcing five vacancies in the Constitutional Court and inviting members of the public, in terms of section 180(4)(b) of the Constitution of Zimbabwe, to nominate suitably qualified persons to fill these positions. The advertisement states the qualifications for appointment as a Constitutional Court judge and the procedure for submitting nominations to the JSC. MALABA CJ: On 24 August 2018 the Constitutional Court (“the Court”) handed down the abridged version of the judgment in the case in which the applicant challenged the validity of the Presidential election held on 30 July 2018.
Constitutional Court is a creature of the Constitution established in terms of section 166 of the Constitution. Courts are generally created by the Constitution. Section 167 of the Constitution provides for the jurisdiction of the Constitutional Court.
IT is hereby notifi ed that the Minister of Justice, Legal and Parliamentary Affairs has, in terms of paragraph 18(4)(a) of the Sixth Schedule to the Constitution approved the following rules of court made by the Chief Justice for regulating the proceedings of the Constitutional Court:—
