IT is hereby notified, in terms of section 260(2) of the Constitution of Zimbabwe, 2013, as read with section 11A of the Criminal Procedure and Evidence Act [Chapter 9:07], that the Schedule sets out the second review of the general principles upon which the Prosecutor-General decides whether and how to institute and conduct criminal proceedings.
These guidelines were issued by the Prosecutor-General in a Schedule to General Notice 2759 of 2021, published on the 24th September, 2021 [link]. They were issued in terms of section 260(2) of the Constitution, which states:
The first amendments to last year’s new Supreme Court Rules published in SI 84/2018 [link]. Rules 30 and 33 are amended, to clarify the procedure for the Prosecutor-General to apply for the leave of a Supreme Court judge to appeal from a High Court decision or sentence in a criminal matter.
